How to Choose a Lawyer in India: 10 Questions to Ask Before You Hire

Speech bubble for questions to ask a lawyer
In short
The right lawyer is one who listens, explains in plain language, is clear about fees and keeps you updated in writing. Meet more than one advocate if you wish, prepare your papers and ask the questions below.

Choosing a lawyer is an important decision, especially when your property, family or freedom is involved. Here is a simple way to go about it.

Before you meet

  1. Organise your documents in date order: agreements, notices, receipts, court papers and messages.
  2. Write a one-page summary of what happened, with dates, names and what you want as an outcome.
  3. List your questions so that you do not forget them in the meeting.

10 questions to ask

  1. Have you handled matters like mine, and in which courts do you appear?
  2. What are my options, and what are the risks of each?
  3. What do you need from me and by when?
  4. How long might this take? (A good lawyer will give a range and not a promise.)
  5. What is the fee, and what does it cover? What are court fees, travel and other expenses?
  6. How and how often will you update me? Will it be in writing after every hearing?
  7. Who will actually handle my case: you or a junior?
  8. Can the matter be settled through mediation or negotiation?
  9. What will happen if I do not agree with a step you suggest?
  10. Can I have the fee terms written down?

  • Confirms fees and scope in writing
  • Responds within a reasonable time

  • Asks you to sign blank papers or refuses to share court papers
  • Cannot explain the fees
  • Does not return calls for weeks
  • Pressures you to decide on the spot

What the Bar Council rules say

Advocates in India are not allowed to advertise or solicit work, and they must keep client matters confidential. Be cautious of anyone who approaches you aggressively or promises results.

If you are unhappy with your lawyer

Raise your concerns in writing and give reasonable time to respond. If the matter is not resolved, you can ask for your papers back, appoint another lawyer, or approach the State Bar Council for a professional misconduct complaint.
